In its NPR in its NPR, the CPSC considered the possibility of imposing additional requirements for bedside sleepers, like the requirement that these products satisfy the minimum side height requirement for bassinets or at least meet the maximum height requirement for the lowered side rail. The CPSC decided, however, that these requirements were not practical or effective in reducing amount of instances where infants are trapped by the bedside rail and an adult bed. The majority of the incidents covered in the NPR focused on multi-use bedside sleepers which can be converted to different types of furniture, like bassinets or play yards. Several commenters suggested that the CPSC include in the proposed rule a different provision for multi-use bedside sleepers that would enable them to meet the minimum side-height requirements for bassinets using a removable attachment that can be permanently connected or removed when the product is not being used as the bassinet. The CPSC is examining these and other comments received in response to its NPR on bedside sleepers. The Commission will consider these comments when it votes on the final rule which is expected to be issued in the month of November 2021.</p>
